A jury has ordered Universal Studios to pay $12 million to a woman who was seriously injured in a 2003 Metrolink crash in Burbank, finding that one of the company&#8217;s truck<br />
drivers caused the collision.<br />
The verdict is the first against the entertainment giant since the same jury last month found the company liable for the crash that killed two people and injured 32 others.</p>

<p>A Riverside woman was awarded nearly $9 million Wednesday by an Orange County jury for injuries-primarily psychological-she suffered in a 2002 crash between a Metrolink commuter train and a freight train that killed three people and injured more than 260.</p>

			<content:encoded><![CDATA[<p>Metrolink worker sued Burlington Northern Santa Fe, saying his alcoholism  returned after the fatal 2002 Placentia collision.</p>
<p>A metrolink conductor  who said his drinking problems resumed after the Placentia train crash in 2002  will receive $8.5 million to settle his lawsuit against one of the nations  largest railroads.<br />
Patrick Phillips of Riverside agreed Tuesday to settle his suit against  Burlington Northern Santa Fe Railway Co. The case was set to go to trial next  week in Orange County Superior Court.<br />
Phillips, now 52, suffered minor head injuries the morning of April 23,  2002 when a Burlington Northern Freight train crashed into a Metrolink commuter  train in Placentia. Three people died and more than 260 were injured in the  early morning crash.<br />
Though his injuries were slight, the conductor alleged that the trauma  was serious enough to trigger a resurgence of his severe alcoholism, which he  said he had controlled since rehabilitation in the early 1990&#8217;s.<br />
&#8220;I have never seen a case like this in 30 years, yet it is indeed what  happened here,&#8221; said <a href="http://www.rkallp.com/metrolink-disaster-lawyers.html" target="_blank">Jerome L. Ringler</a>, Phillips&#8217; attorney.<br />
&#8220;We had extensive medical evaluations by a variety of neurological  specialists. All were in accord that his injury, although minor, changed his  behavior.&#8221;<br />
After the train crash, Phillips was hospitalized for evaluation but  released about two hours later, Ringler said. In the months after the crash,  however, Phillips allegedly resumed his alcohol abuse, resulting in at least two  other hospitalizations.<br />
Ringler said his client was finally diagnosed with alcohol-related  dementia, a sever mental deficiency.<br />
Phillips, who is now disabled after working 12 years for Metrolink, was  unavailable for comment. He is living with a sister in Riverside.<br />
Under terms of the settlement, Phillips will receive $8.5 million,  including interest, paid out over 20 years. The amount is worth about $4.5  million in today&#8217;s dollars.<br />
Officials for Burlington Northern Santa Fe, one  of the nations four largest railroads, confirmed the settlement but declined to  discuss the case.<br />
Phillips&#8217; lawsuit is one of more than 100 Civil cases stemming from the  Placentia crash, which federal investigators said was caused by an inattentive  Burlington Norther crew that missed a warning signal.<br />
The lawsuits allege the collision could have been prevented by an  automatic braking system, long sought by the federal National Transportation  Safety Board.<br />
They also contend that the freight train crew was fatigued by  overwork and that the Burlington Northern conductor had a history of losing  track of signals.<br />
In December, an Orange County jury awarded Pamela Macek, 53, also of  Riverside, about $9 million in damages for psychological and physical injuries  suffered in the crash. Her case was the first to go to trial.</p>

			<content:encoded><![CDATA[<p>A federal appeals court on Thursday left in place a lower court&#8217;s ruling that allowed Washington state pharmacists to refuse to sell emergency contraceptive &#8220;morning after&#8221; pills on religious grounds.</p>
<p>A federal judge in Seattle suspended state rules that required pharmacies to dispense &#8220;Plan B&#8221; and other emergency contraceptives that prevent fertilized eggs from implanting, which some people believe is the same as abortion.</p>
<p>U.S. District Judge Ronald Leighton found that the state rules force pharmacists into an unconstitutional choice between their religious beliefs and their work.</p>
<p>State officials and several women had asked the Ninth U.S. Circuit Court of Appeals to suspend the judge&#8217;s preliminary injunction, which bars them from enforcing the law, while they appeal his ruling.</p>
<p>In a split decision, the appeals court denied that request. finding that the state and the women did not show that they would suffer irreparable harm if the injunction stays in place pending the appeal.</p>
<p>The justices granted the state&#8217;s motion to speed up the appellate proceedings, which were set for oral argument on June 3 in Seattle.</p>

			<content:encoded><![CDATA[<p><strong>SAN DIEGO &#8212; </strong>A prominent North County surgeon could be in trouble with the state medical board and learned he could lose his license.</p>
<p>Dr. Dennis Nigro is the subject of a hearing at the state building in which he is accused of having sex with a patient.</p>
<p>Nigro admitted to having a brief affair with a woman in 2003, but said she was no longer in his care during their relationship.</p>
<p>Nigro’s <a href="http://www.khourilaw.com/attorney-profile.html" title="Medicare Defense Attorney, Michael Khouri">lawyer, medicare defense attorney Michael Khouri</a>, said, “The woman does not believe Dr. Nigro was her doctor when the sex occurred.”</p>
<p>“There is documentation required to terminate relationship. It was not done in this case,” said Deputy Attorney General Mary Agnes Matyszewski.</p>
<p>An administrative law judge will issue a proposed decision that will be sent to the state medical board for final disposition.</p>
<p>Nigro’s license could be suspended if discipline is deemed necessary.</p>
<p>On the subject of the &#8220;worst five things a doctor can do,&#8221; Steve Alexander provided the Investigation Team the list of the &#8220;worst five&#8221; and then commented on each individual item. There were no specific cases or doctors mentioned in the course of this interview. Among the items provided by Mr. Alexander as one of the &#8220;worst five things a doctor can do,&#8221; was a sexual relationship between a doctor and his or her patient. Clearly, in reporting the allegations against Dr. Dennis Nigro there was no intention or effort to tie Alexander’s separate interview specifcally to the Dr. Dennis Nigro case. <!--stopindex--></p>

			<content:encoded><![CDATA[<p>A Texas woman has sued Blockbuster Inc. alleging the video rental company transmitted her personal information to Facebook.com through the Web site&#8217;s Beacon marketing program.</p>
<p>Cathryn Elaine Harris, of Dallas County, Texas, claims that Beacon, which Facebook launched in November, got the information from Blockbuster through computer tracking programs without her permission.</p>
<p>In her complaint, filed April 9 in U.S. District Court for the Eastern District of Texas, Harris claims that by allowing Facebook to get at information on her movie renting and buying habits Blockbuster violated the Video Privacy Protection Act.</p>
<p>Randy Hargrove, a spokesman for Dallas-based Blockbuster, said the company denies the allegations.</p>
<p>&#8220;Our alliance with Facebook included numerous levels of privacy protection built in for our online subscribers,&#8221; Hargrove said.</p>
<p>Beacon, which members could always opt out of, tracks purchases Facebook members make online and sends members&#8217; &#8220;friends&#8221; alerts about the transactions. Within a few weeks of its launch, thousands of complaints poured in from Facebook users who hadn&#8217;t realized it would share their commercial activity. Now users must opt into the program if they want it.</p>
<p>But Harris&#8217; lawsuit, which she hopes the court will certify as a class action, claims the damage is already done and that Blockbuster continues to share her information.</p>
<p>&#8220;To this day, however, Facebook still receives personal identifiable information from participating Web sites &#8230; whether the Facebook member has chosen to distribute their information or not,&#8221; the complaint says. &#8220;To this day, Blockbuster Online members remain unsuspecting victims.&#8221;</p>
<p>It was not clear from the complaint whether Harris is claiming that Blockbuster is sharing new information.</p>
<p>Palo Alto, Calif.-based Facebook did not immediately respond to a call requesting comment.</p>
<p>Harris&#8217; lawyers at The Corea Firm and Otstott and Jamison in Dallas could not immediately be reached Thursday evening.</p>
<p>Congress passed the Video Privacy Protection Act in 1988 in response to the experience of U.S. Supreme Court nominee Robert Bork, whose video rental history was obtained by a newspaper.</p>

<p>The survey asked attorneys about compensation, promotions, the complexity and importance of work assignments and client contact opportunities based on diversity.</p>
<p>Based on the results of the survey, CABA was to recognize Bilzin Sumberg Baena Price &amp; Axelrod among firms with 50 of more attorneys and Kenny Nachwalter among firms with 20 to 49 attorneys at a reception this past Thursday night.</p>
<p>The goal of the survey was to identify which firms have greater success in making diversity a priority, said Coral Gables, Fla., attorney Nelson Bellido. He is chair of CABA&#8217;s diversity committee and a partner with Concepcion, Sexton &amp; Martinez.</p>
<p>&#8220;This is going to allow the firms to identify and prioritize certain diversity goals,&#8221; he said. &#8220;What CABA is doing is [asking law firms], &#8216;Are you walking the walk, or are you just talking?&#8217;&#8221;</p>
<p>Respondents overall were highly positive about diversity prospects and achievements at their firms. Attorneys who expressed no opinion generally outscored attorneys expressing negative sentiments about their firms.</p>
<p>Overall, attorneys at large firms appeared to be more satisfied than attorneys at smaller firms with the state of diversity at their firms.</p>
<p>A bigger percentage of attorneys from large firms, 17 percent, felt they were treated differently because of race, gender or sexual orientation than the 12 percent at medium-size firms.</p>
<p>When it came to the issue of pay equity, lawyers from larger firms seemed more satisfied with minority lawyer compensation than those at smaller firms. About 67 percent of large firm lawyers agreed that minority lawyers were as likely to receive raises as nonminority lawyers compared with 63 percent at smaller firms.</p>
<p>The question generating some of the highest negatives in the survey asked if minority and nonminority attorneys have an equal chance at leadership roles. About 11 percent of respondents at large firms and 10 percent at smaller firms did not see a level playing field.</p>

			<content:encoded><![CDATA[<p>A high school student won&#8217;t be allowed to proceed with a lawsuit against his school district for instituting a policy that barred him from expressing his opposition to homosexuality, a federal appeals court ruled Wednesday.</p>
<p>The U.S. 6th Circuit Court of Appeals, in a 2-1 vote, said Boyd County High School student Timothy Morrison failed to show that he was harmed by the policy that was later changed. Judge Deborah L. Cook, joined by Judge John R. Adams, also said Morrison didn&#8217;t show how winning a lawsuit seeking only $1 in damages would rectify his situation. Judge Karen Nelson Moore dissented.</p>
<p>&#8220;This case should be over,&#8221; Cook wrote. &#8220;Allowing it to proceed to determine the constitutionality of an abandoned policy — in the hope of awarding the plaintiff a single dollar — vindicates no interest and trivializes the important business of the federal courts.&#8221;</p>
<p>The ruling is a reversal of a previous ruling that held Morrison should be allowed to pursue the lawsuit.</p>
<p>Morrison, a senior at Boyd County High School, sued the Boyd County school district over a policy that required students to undergo anti-harassment training. He claimed the policy threatened him with punishment for expressing religious beliefs in opposition to homosexuality. Morrison is a professed Christian who believes his religion requires him to speak out against what he sees as behavior that doesn&#8217;t comport with his understanding of Christian morality.</p>
<p>Morrison was never punished under the policy, which was later changed to exempt speech that would normally be protected off campus.</p>
<p>The school district adopted the policy and established the anti-harassment training as part of a 2004 legal settlement that ended a lawsuit between the school district and a now-defunct gay-rights group that wanted recognition as an extracurricular group.</p>
<p>Members of the Boyd County High School Gay Straight Alliance argued that the school district violated their constitutional rights by refusing to allow them to meet on campus.</p>
<p>Joel Oster, an attorney for the Alliance Defense Fund, a Christian law group that represents Morrison, didn&#8217;t immediately return a telephone message left at his Scottsdale, Ariz., office. Winter Huff, an attorney representing the school district, didn&#8217;t immediately return a call to her Somerset office.</p>
<p>Sharon McGowan, an attorney for the American Civil Liberties Union, which supported the Alliance Defense Fund in arguing that Morrison should be permitted to pursue his case, said the ACLU was disappointed by the decision.</p>
